Govs call for status quo in designation of police chiefs in provinces without prior consultation

Affected governors, led by Gov. Antonio Kho of Masbate, share their grievances relative to the designation of OIC police directors in their provinces without prior consultations.

The PNP may have violated existing laws in its recent designations of new police provincial directors.

At least 14 governors have expressed concern over not having been consulted prior to the designation of new PNP provincial directors.

During its general assembly last January 12, the local chief executives passed a resolution calling on PNP Dir. Gen. Oscar Calderon to immediately stop the turn-over of provincial police directors in provinces where the governors have not been consulted beforehand.

Among the provinces where the PNP has failed to consult with the governors prior to the turn-over of the police chiefs include: Masbate, Camarines Norte, Camarines Sur, Albay, Zamboanga del Norte, Capiz, Misamis Occidental, Lanao del Norte, Southern Leyte, Cavite, Nueva Vizcaya, Batangas, South Cotabato, Cagayan North and Sarangani.

The governors stressed that, “the replacement of incumbent PNP Provincial Directors without recognizing the authority of the concerned Provincial Governor violates the provisions of the PNP, and circumvents the prior consultation requirement under the Local Government Code of 1991.”

Furthermore, the PNP Law requires that the concerned governor shall appoint the Police Provincial Directors from among a list of three qualified nominees.

In the case, however, of these 15 provinces, the PNP failed to secure the prior approval of their respective governors, and the latter were also not consulted in the appointment of the new provincial police director.

In the resolution, the league maintained its position that, “violating the provisions on the powers, prerogatives and authority of the Provincial Governors under the PNP Law will weaken the initiatives to uphold the rule of law, disrupt peace and order programs in the countryside, and undermine government structures to enforce the law and promote justice in the Philippines.”

The governors added that terminating the designation of a PNP Provincial Director who enjoys the trust and confidence of the concerned governor, and the appointment of an Officer-in-Charge without prior approval of the concerned LGU diminishes local autonomy and violates the spirit of both the Local Government Code of 1991 and the PNP law. Points raised by the governors during the discussion of the issue on police chiefs:
  • Gov. Kho backed a resolution strongly urging the PNP Director General Oscar Calderon to immediately stop the turnover of PNP provincial directors in provinces which were not consulted in the designation of new PNP provincial directors.
  • The governors cried foul over the lack of consultation and the wanton disregard of their power to have a say on the nomination of the PNP provincial director in their jurisdiction.
  • Gov. Lee insisted that apart from this resolution, an immediate representation to the authorities concerned is necessary, given the time that they have before the COMELEC election ban.
  • Gov. Singson challenged and asked the governors on what measure to take in times when they are not consulted in such matters.
  • Gov. Reyes of Palawan pointed out that the issue at hand is a political issue and it calls for a political solution.
  • Gov. Bermejo stressed that a mere resolution will be moot and academic and will not convincingly resolve the issue in favor of the governors.
  • Gov. Sanchez insisted that his cause to fight for the right of governors to choose the PNP chief in their jurisdiction is not an individual pursuit but a collective cause of all governors.
  • Gov. Villafuerte added that if such disregard for the power of governors can be done to one, it can happen to all governors as well.
  • Gov. Aumentado, in response to the concern over the turnover of 38 provincial directors, called the President and requested her to resolve the issue favoring the governors.
  • Gov. Garcia of Bataan made a clarification that not all of the 38 Provincial Directors were transferred without consultation. He manifested that some governors were also consulted prior to the turnover of PNP provincial directors.
  • Gov. Joson also called PNP Director General Calderon to raise this concern. Gen. Calderon immediately responded and told Gov. Joson that he will be sending Gen. Versoza to have a dialogue with the Governors in order to settle the matter.
