LPP backs Bataan in case vs. Petron for collection of P1.7B unpaid RPT

The Province of Bataan, under the leadership of Gov. Tet Garcia, has the full support of the League of Provinces of the Philippines in prosecuting its case against Petron Corp. to collect its unpaid real property tax amounting to P1.7 billion.

The National Executive Board approved Resolution No. 2008-001 fully supporting the Province of Bataan in pursuing its case against Petron Corp. before the Supreme Court, on the ground that the collection of the unpaid realty taxes is within its powers under the 1987 Constitution and the Local Government Code of 1991.

It may be recalled that the Province of Bataan, through its Provincial Treasurer, filed a case before the Supreme Court questioning an Order dated 5 November 2007 of the Regional Trial Court, Branch 3, Bataan, which enjoined the Province of Bataan to conduct public auction of Petron Corporation’s machineries to collect unpaid real property taxes.
