House bills seek transfer of jurisdiction of provincial jails to BJMP

House Bill No. 996 and House Bill No. 3381, authored by Reps. Arthur Y. Pingoy Jr. and Salvador H. Escudero III, respectively, are now being deliberated in the House Committee on Public Order and Safety.

Both bills seek to place the provincial jails under the jurisdiction of the Bureau of Jail Management and Penology (BJMP), amending Sections 61, 62, and 63 of Republic Act No. 6975 otherwise known as the “Department of the Interior and Local Government Act of 1990.”

The main difference between the two bills is in the funding mechanism. HB 996 seeks an annual appropriation of a measly P250M from the Annual General Appropriations Act. HB 3381, on the other hand, does not provide for a specific amount for the administration and operations of the provincial jails but mandates the Provincial Government to appropriate funds for the subsistence of detainees and convicted prisoners in the province.

In addition, both bills do not have provisions for a Transitory Period which will create confusion if ever the bill is enacted into law.

To facilitate an objective deliberation on the matter, Cong. Rodolfo W. Antonino, Chairman of the House Committee on Public Order and Safety, has requested that the League of Provinces to come up with its official position on the aforesaid matter. Further, the League has been requested to provide data on how much the provinces spend annually in the operation and maintenance of the provincial jails.

Considering that the issue may have political implications, LPP Secretariat is currently conducting a survey in order to come up with an objective reflection of the sentiments of the governors on the aforesaid matter. Gov. Loreto Leo Ocampos has enjoined all governors to accomplish the survey forms immediately to allow time for the drafting of an official position paper. (RTLimbago)
