RESOLUTION No. 2006-31

REQUESTING HER EXCELLENCY PRESIDENT GLORIA MACAPAGAL-ARROYO TO ADVISE THE PHILIPPINE NATIONAL POLICE (PNP) TO OBSERVE THE REQUIREMENTS IN THE APPOINTMENT OF PNP PROVINCIAL DIRECTORS

WHEREAS, the PNP Provincial Director shall be appointed by the Provincial Governor from among the list of three (3) nominees of PNP in accordance with the PNP Law;

WHEREAS, this has been circumvented several times in the past the recent incident of which is the baseless relief of the Batangas PNP Provincial Director, and the designation of an Officer-in-Charge (OIC) without any prior consultation with the Governor of Batangas;

WHEREAS, the relief of a PNP Provincial Director who enjoys the trust and confidence of the Provincial Governor and the designation of an OIC without prior consultation diminishes local autonomy and violates the letter and spirit of the Local Government Code of 1991 and the PNP Law;

WHEREAS, the circumvention of the provisions of the Local Government Code of 1991 and the PNP Law would prejudice peace and order, and public safety and security;

THEREFORE, BE IN RESOLVED, as it is hereby resolved that the League of Provinces of the Philippines (LPP) requests Her Excellency President Gloria Macapagal-Arroyo to advise the Philippine National Police (PNP) to observe the requirements in the designation of the PNP Provincial Director;

RESOLVED FURTHER, that the League urges the PNP to immediately rectify the non-observance of the procedures in the relief of the PNP Provincial Director and the designation of an OIC without prior consultation;

RESOLVED FINALLY, that a copy of this Resolution be presented to Her Excellency President Gloria Macapagal-Arroyo and PNP Director-General Oscar Calderon for their consideration and action.
